This privacy policy (hereinafter the “Privacy Policy”) applies to the processing of data carried out by EasyBroker LLC (hereinafter, “EasyAviso”), with address at 8345 NW 66 St. #4672. Miami, FL 33166, United States and tax identification number 26-0485225; on or through the EasyAviso Platform and/or the EasyAviso Services made available to Users by EasyAviso. This Privacy Policy is complementary to the Terms of Service, forming an integral part thereof. All capitalized terms found in this document that are not expressly defined shall have the same meaning assigned to them in the Terms of Service.
We know that it is important for our Users to know how we use their personal information, with whom we share it, and what security measures we adopt to protect it. For this reason, in this Privacy Policy we explain, as clearly as possible, what data we collect, how we process it and for what purposes, with whom we share it and what are the rights of the Users when they access, browse or use the Services provided through the website https://www.easyaviso.com, or other technologies, websites, platforms or applications that EasyAviso makes available to Users and that do not have their own privacy policy (hereinafter, all together, the “EasyAviso Platform”).
This Privacy Policy applies to all Personal Data processed or to which EasyAviso has access by virtue of or within the framework of the EasyAviso Platform and/or the EasyAviso Services will be treated in accordance with this Privacy Policy. This Privacy Policy informs how EasyAviso treats the personal information of Registered Users and Users who visit the EasyAviso Platform without registering and/or any other personal information collected and/or processed by EasyAviso through the EasyAviso Platform, and/or the EasyAviso Services.
EasyAviso may also process Personal Data that Users provide through User accounts on social networks or third-party platforms (hereinafter the "Third-Party Platforms", such as Facebook, Instagram, Google, X, Linkedin, among others). These Third-Party Platforms have their own privacy policies regarding the processing of Personal Data. We recommend that you carefully review the privacy policies of these Third-Party Platforms when using them in order to understand the processing of their users' Personal Data.
USERS OF THE EASYAVISO PLATFORM WILL BE REQUESTED FOR EXPRESS, FREE AND INFORMED AUTHORIZATION OF THIS PRIVACY POLICY DURING THE REGISTRATION PROCESS WITHIN THE PLATFORM. WITHOUT LIMITING THIS, IT IS MADE CLEAR THAT, BY ACCESSING, ENTERING PERSONAL DATA OR USING THE EASYAVISO PLATFORM AND/OR THE SERVICES IN ANY WAY, THE USER CONFIRMS THAT HE/SHE HAS READ, UNDERSTOOD, AGREED, ACCEPTS AND EXPRESSLY CONSENTS TO THIS PRIVACY POLICY IN A FREE AND INFORMED MANNER. IF YOU DO NOT AGREE WITH THIS POLICY, WE AT EASYAVISO RECOMMEND NOT USING THE EASYAVISO PLATFORM AND/OR THE SERVICES.
All persons who access and/or use the EasyAviso Platform will be considered a “User”, whether or not they are registered. Every User who registers on the EasyAviso Platform will be considered a “Registered User”, who may register as:
- Advertiser User. Those Registered Users who register on the EasyAviso Platform in order to upload Advertisements about Properties that are for sale or rent, and receive communications from Homeseeker Users.
- Homeseeker User. Those Registered Users who register on the EasyAviso Platform in order to search for Properties, manage their preferences, administer selected properties and/or contact the Advertiser Users who upload said Properties.
- Owner User of the Workspace or Owner User, indistinctly. User who registers for the purpose of creating and manage a Workspace and is the owner of the Workspaces it creates and the Plans it contracts.
- Administrator User. User designated by an Owner User to manage a Workspace, in accordance with the Owner User's preferences.
The use of the EasyAviso Platform and the provision of the Services by EasyAviso will involve the collection and processing by EasyAviso of certain personal data, “Personal Data” being understood as all information related to people that allows their identification directly or indirectly. Depending on the applicable regulations, information regarding legal entities may or may not be included in the definition of Personal Data.
In order to collect and process your Personal Data, EasyAviso requests the User's prior, express and informed authorization, which may be withdrawn by the User through the channels that EasyAviso makes available and the procedure indicated in this Policy, provided that there is no legal or contractual obligation that requires EasyAviso to retain its information.
The User will be solely responsible for the veracity, accuracy, integrity, validity, authenticity and certainty of the information provided to EasyAviso, and must notify about any corresponding update or modification immediately. Without prejudice to the foregoing, EasyAviso may verify the Personal Data and/or information provided – by itself or through third parties – by resorting to public entities, specialized companies, among others, to which the User expressly consents.
The Personal Data that EasyAviso collects and requests are the following:
Regarding Homeseeker Users
- Identification data: First and last name.
- Contact information: Email and phone number.
- Access credentials to your User Account on the EasyAviso Platform.
- Messages sent to Advertiser Users through the EasyAviso Platform.
- Address.
- Profile photo and position, if the User so desires.
Regarding Advertiser Users, Administrator Users and Owner Users
- Identification data: First and last name
- Contact information: Email and phone number.
- Access credentials to your User Account on the EasyAviso Platform.
- Profile photo, if the User so desires.
Regarding all Users
- Traffic, views, interactions, searches and any other activity of Users on the EasyAviso Platform.
- Personal Data that Users provide through Advertising Platforms. third parties.
- If the User contacts EasyAviso to request information or make a comment through the EasyAviso Platform and/or available contact channels, we may ask the User for his or her first and last name, cell phone number, and email address.
- We also collect information about the devices through which the User accesses the EasyAviso Platform and/or the Services. We collect data related to the browser used, the mobile operator, brand, model, and operating system of the device, IP address, and geolocation of the device from which the User accesses.
- In order to understand and analyze the use that Users make of the EasyAviso Platform and/or the Services, EasyAviso uses third-party analytical services. These providers use technologies such as cookies, web server logs and web beacons that collect information (including IP address and geolocation) that may be disclosed to the providers of such analytics services, as well as to other third parties who will use the information collected for, among other purposes, evaluating the use of the EasyAviso Platform.
In certain cases, failure to provide certain Personal Data required by EasyAviso will prevent EasyAviso from providing access to the EasyAviso Platform and/or its Services.
All exchanges of information or communications that take place between Advertiser Users and Homeseeker Users outside of the EasyAviso Platform are not monitored or controlled by EasyAviso at any time. Consequently, EasyAviso does not will not be considered as the controller or processor of Personal Data regarding the processing of Personal Data that Users exchange through such communications.
3.1. Use of Cookies
At EasyAviso we use cookies to store our Users' preferences, customize the content of the EasyAviso Platform, based on the type of browser of the Users or other information that the User sends.
Therefore, in order to make full use of the features and services of the EasyAviso Platform, the User must accept certain cookies. By using and browsing the EasyAviso Platform, the User accepts the use of cookies by EasyAviso under the characteristics described below.
“Cookies” are small text files that a website places on the PC, phone or any other device used to access it, with information about the user's navigation on said site. Cookies are necessary to facilitate navigation and make it more user-friendly, and they do not harm the computer or device that the User uses to access it.
“Cookies” do not contain information that allows the User to be identified and by themselves do not allow the User's personal contact information to be obtained, such as their email address. If the User decides to provide personal information to the EasyAviso Platform, for example, through forms, such information may be linked to the data stored in the cookie. The information collected through cookies consists of information about the browser used by the User, the type of device, operating systems, Internet service providers, the sections of the EasyAviso Platform that the User visits, the links that are established and other information of similar characteristics. “Cookies” are an essential part of how a website works.
The main objective of using “cookies” is to improve the User's browsing experience. For example, “cookies” help remember user preferences (language, country, etc.) during navigation and on future visits. The information collected in the “cookies” allows EasyAviso, for example, to improve the Services and the EasyAviso Platform, through estimates of numbers and patterns of use, the adaptation of the Services and the EasyAviso Platform to the individual interests of the User, the acceleration of searches, among others.
Additionally, it is known that EasyAviso may use the “cookies” to target advertising to its Users based on their navigation.
EasyAviso in no way obliges the User to keep the “cookies” active, but informs the User that some functions and sections of the EasyAviso Platform may be disabled or not function correctly if they are deactivated or blocked.
DEACTIVATING/BLOCKING COOKIES OR DELETING THEM MAY AFFECT THE OPTIMAL USE OF CERTAIN AREAS OF THE EASY PLATFORM NOTICE OR PREVENT CERTAIN FUNCTIONALITIES, AS WELL AS AFFECT THE OPERATION OF THIRD PARTY SERVICES.
The configuration of cookie management depends on the browser used by the User. Below are instructions and links to guides for managing cookies for the main desktop browsers:
- Microsoft Edge. The User must click on the icon with the three dots in the upper right corner and then on "Settings". In the menu on the left, select "Cookies and site permissions" and adjust the cookie settings. More information is available at this link.
- Google Chrome. The User must click on the icon with the three dots in the upper right corner and then under "Settings", select "Advanced" and under "Privacy and security" click on "Site settings". For browsers other than those mentioned above, it is necessary to consult the corresponding guide to find out how to manage cookies.
4.1 Purposes
Users agree that their Personal Data will be used for the following purposes or objectives, to which Users expressly consent:
- Identify Users and their devices;
- Provide a means of communication for Homeseekers Users to contact Advertiser Users in accordance with the provisions of this Privacy Policy and the Terms of Service;
- Attend to requests; as well as analyze and, where appropriate, formalize the requested attention;
- Manage and process the EasyAviso Platform and the Services and related services;
- Allow Owner Users and Administrator Users to manage the Workspaces;
- Improve the content, functionalities and layout of the EasyAviso Platform for Users;
- Enable the creation and management of Property Boards, including the possibility of sharing it with other Users;
- Analyze, store and process said information, including grouping it according to specific profiles for marketing and research, promotional, commercial or advertising purposes;
- Manage the sending of communications with notices, messages, news, newsletters, advertisements for products and services of EasyAviso or third parties with which EasyAviso has a relationship, whether through printed, electronic, telephone and/or in-person means for advertising, promotional, commercial prospecting or marketing purposes, always with the option for the User to unsubscribe;
- Send information and notify the User about updates to the EasyAviso Platform and/or the Services; and
- Analyze and monitor the use of the EasyAviso Platform and its functionalities for business, statistical or promotional purposes.
5.1 User Rights
Users have the following rights:
- Access. Access and know which of your Personal Data we have, what we use it for and the use we give to it.
- Rectification. Request the correction of your Personal Data if it is outdated, inaccurate or incomplete.
- Cancellation. Request that we delete your Personal Data from our records or databases, under the reasons provided for in the applicable regulations and whenever this is legally possible.
- Opposition. Request that we end the processing of your Personal Data for specific purposes.
To exercise these rights or any other rights granted to Users by applicable regulations, as well as for any communication related to the processing of their Personal Data by EasyAviso, Users may contact EasyAviso by email addressed to hola@easybroker.com. In all cases, the User must provide:
- Identification of the right you wish to exercise.
- Name and surname, name of your User Account (if you are a Registered User), country of residence and email address to which notifications regarding this process may be received. If this is not provided, it will be understood that the response must be sent to the email address from which the request was received.
- Identification of the User and his/her legal representative or agent, as appropriate, and authentication of his/her identity, in accordance with the procedure and requirements established by EasyAviso for this purpose;
- Clear and precise description of the Personal Data over which he/she seeks to exercise his/her rights, except in cases where the User exercises his/her right of access by requesting confirmation from EasyAviso as to whether his/her Personal Data is being processed by it. Compliance with the following requirements depends on the type of right exercised by the User:
- In requests for rectification, the User must indicate the necessary modifications or updates to be made and, where applicable, provide the supporting documents.
- In requests for cancellation, the User must indicate the reason invoked and provide the supporting documents, if applicable.
5.2 Requests
At any time, the User may contact us, through our contact channels, to complain about a violation of their rights with respect to the processing of their Personal Data. If all the requirements mentioned above are met, we will address the situation as soon as possible.
However, if the User considers that he or she has not obtained full satisfaction in the exercise of his or her rights, he or she may file a complaint with the competent personal data protection authority, which will be responsible for dealing with complaints and claims filed in relation to non-compliance with the Personal Data protection regulations.
At EasyAviso, we will use your Personal Data to the extent that the relationship with the User is in force and will be used strictly for the fulfillment of the purposes detailed above. The specific retention period for which EasyAviso will retain the Personal Data will depend on each of the categories of Personal Data that are subject to processing, the User's relationship with EasyAviso and the applicable regulations. In any case, EasyAviso will store and use the Personal Data after the relationship has ended in the following cases:
- For the time required to comply with legal or contractual obligations, or instructions from administrative authorities and/or judicial, arbitration or administrative rulings or resolutions;
- For ten years and/or for the additional period required by the applicable regulations for accounting and/or legal purposes, unless the applicable regulations establish a shorter or longer retention period for accounting and/or legal purposes.
At EasyAviso we comply with the applicable regulations in order to provide our Users with the best experience.
When the User provides us with their Personal Data, we keep it strictly confidential and reserved. To ensure the security of Personal Data, we adopt technical and organizational measures specifically designed to protect the Personal Data provided against accidental, illegal or unauthorized destruction, loss, alteration, access, communication or use. We take into account the security standards and procedures established by applicable regulations and we continually evaluate new technologies to protect this information.
However, as is known, existing technical means that provide security are not impregnable, and even when we adopt all reasonable security precautions, it is possible to suffer manipulation, destruction and/or loss of information.
In the event of security incidents affecting Personal Data, EasyAviso will proceed to notify Registered Users about them, provided that this is required by applicable regulations and in accordance with what is indicated therein.
Furthermore, if the User considers that his/her interaction with EasyAviso is no longer secure (for example, if he/she believes that the security of his/her account has been put at risk), we ask that he/she contact us via email: hola@easybroker.com.
This Policy extends to all affiliates, subsidiaries, branches, agencies, representations, controlling companies, controlled companies, related companies and/or natural or legal persons that work with EasyAviso (hereinafter the “Entities Related to EasyAviso”). EasyAviso is committed to ensuring the security and confidentiality of Users' Personal Data in all operations carried out on and through EasyAviso.
By using the EasyAviso Platform, the User gives his or her free, express and informed consent for EasyAviso to share his or her Personal Data with the Entities Related to EasyAviso with which EasyAviso maintains agreements or conventions, in order to fulfill the indicated purposes.
In particular, the User consents to his or her Personal Data being shared with the Entities Related to EasyAviso. as well as with clients, potential clients, investors, potential investors, business partners or sponsors of EasyAviso. In such cases, the entities that receive Personal Data from Users may only use such Personal Data for the purposes described in this Privacy Policy, and it is expressly prohibited to use the Personal Data received for different purposes unless such entities have another legal basis admitted by the applicable regulations for the processing of Personal Data, including, but not limited to, the express, free and informed consent of the Users.
Likewise, Homeseekers Users consent that their Personal Data may be shared with Advertiser Users, who will receive the necessary information to contact Homeseekers Users when the latter require it. Advertiser Users are required to use the Personal Data of Homeseekers Users only for the purposes specified in this Privacy Policy and in accordance with applicable regulations.
EasyAviso may also share your Personal Data with:
- Service providers. Given the complexity of our services, there are some companies or entities that provide us with services that involve the processing of Personal Data. Thus, the Personal Data of Users will be shared with our hosting service providers, cloud storage, marketing service providers including but not limited to email marketing and email marketing automation, technology providers, information security providers, auditing, accounting or legal service providers, among others. Our providers provide services in accordance with our instructions and for the purposes detailed in this Privacy Policy. We do not authorize them to reveal or disclose the Personal Data of our Users except for those uses that are strictly necessary for the provision of services on our behalf, or to comply with legal obligations.
- Public authorities. We share information with administrative and judicial authorities that, in the exercise of their jurisdiction, require information from EasyAviso, our service providers and/or our business partners, even if there is no executive or judicial order or subpoena to that effect, for the purposes of: (a) collaborating in the investigation and reporting of fraud, piracy, violations of intellectual or industrial property or any other illegal act, as well as any activity or circumstance that could generate legal liability for EasyAviso and/or its users; (b) safeguarding a public interest, the procurement or administration of justice, the recognition, exercise or defense of a right in a judicial or administrative process, and/or the resolution of disputes; and (c) to comply with any applicable law, regulation or legal provision, or any mandate of a competent authority duly founded and motivated.
- Officials. Whether judicial, administrative, government officials or those in charge of conflict resolution. We share information with authorities, courts, conciliators, mediators, or entities that intervene in the resolution of controversies in order to resolve disputes that may arise in which we have any kind of intervention or participation.
Finally, we also share information to: (a) protect and defend our rights or property; (b) protect the personal safety of our employees, agents, representatives or Users; and/or (c) protect the integrity of the online community of our services.
The User expressly agrees that his/her Personal Data collected through the EasyAviso Platform and/or the EasyAviso Services may be transferred internationally, for which the User provides his/her free, express and informed consent. Likewise, to the maximum extent permitted by applicable regulations, the User expressly accepts and acknowledges that when EasyAviso transfers the Users' Personal Data to other countries for the purposes and in the manner indicated in this Policy, this transfer may include countries or jurisdictions that do not offer the same levels of protection as those provided for by applicable regulations. In relation to the above, the User is informed that whenever required by applicable regulations, safeguards have been implemented that guarantee an adequate level of protection of Personal Data in accordance with applicable regulations.
In particular, the User expressly agree that your Personal Data will be hosted and processed in the United States of America by EasyAviso and by the company Amazon Web Services, within the framework of the cloud hosting services provided by said company.
The EasyAviso Platform may contain links to other websites for the convenience and information of Users. These websites may be operated by entities that are not linked to EasyAviso. Typically, these linked or connected websites have their own privacy policies or notices, so we recommend that Users read them when visiting these sites. This also applies to the EasyAviso Platform that is found on social media pages managed by third parties.
EasyAviso does not assume any responsibility for links to third-party websites or platforms or for the content of websites or platforms other than our own, nor for the use made of such websites, or for the personal data privacy practices in force therein, beyond what is expressly indicated in this Privacy Policy.
EasyAviso may make modifications or updates to the Privacy Policy. When modifications to the Privacy Policy are substantial (e.g., if they involve the processing of new categories of Personal Data, the use of Personal Data for new purposes or the transfer of Personal Data to third parties), these modifications will be communicated in a timely manner and through the channels established by EasyAviso to Users so that they can accept or reject them, which will imply the revocation of their consent for the processing of their Personal Data. However, the revocation of consent will not apply when Easyaviso has a legal or contractual obligation to process all or part of the Personal Data, in which case it will store them for the time and for the purposes necessary to comply with such obligations.
